Mid-Atlantic Premier Pony Sale

Leigh Smith, Debora Hayward, Twin Palms Farm, all volunteers, auctioneer, and handlers are operating as an independent contractors. Acting only as the vehicle to bring buyers and sellers together. Together, these entities are called "Sale Conductors". Sale Conductors will be held harmless, with no exceptions for injury, theft, death or breach of warranty.
The highest bidder will be the buyer, and if any dispute arises between two or more bidders, the horse in dispute will immediately be offered again for advance bids. If there is no advance, the horse shall go the person from whom the auctioneer recognized as the last bid.
Terms of Sale: Cash, debit card, credit card. No personal checks will be accepted. Payment must be made immediately upon the completion of the sale.
All payment must be made to the sale cashier. At no time may any part or the entire purchase price be paid directly to the consignor. All fees must be paid to the cashier before the horse will be released.
Buyers assume all expenses and risks of their horse purchase upon the fall of the gavel including any subsequent injury or death. Upon payment, the cashier will issue a release for the horse. Buyer must present this release in order to remove the horse from the premises. All horses must be removed before 10am Sunday, September 30, 2012 unless prior arrangements have been made with Twin Palms Farm or Shocco Creek Ranch.
Registration forms, transfers and all other paperwork will be released within two weeks of the sale date.
Every effort has been made to assure the accuracy of the catalog. Sale Conductors are not responsible for errors or omissions and assume no liability on the part of the consignor as to any statement either verbal or written regarding any consignment. All additions and corrections at the sale will supersede the catalog.
Sale Conductors are not responsible to anyone for blemishes, defects, or the physical condition of the any horse at the sale. All responsibility lies between the consignor and the buyer.
If is the consignor’s responsibility to notify the Sale Conductors, in writing prior to the sale of all unsoundness of any kind known to the consignor. Any unsoundness not listed in the catalog will be announced at the time of sale. The buyer has the responsibility to examine the horses before the bidding.
The consignor has the responsibility to inform the Sale Conductor of the fact that the horse is a bleeder, a cribber, a crypt orchid or has been nerved, or has any unsoundness to include defects of the eyes, navicular disease, ring bone, or any cosmetic alteration or enhancement to include false tails. All buyers must examine each horse before bidding, once a bid is final and payment has been made, the buyer cannot involve the Sale Conductor in any dispute. All disputes after payment has been made are between consignor and buyer. There is no guarantee of disposition or compatibility of the horse.
Buyers and spectators must be careful while on the grounds. Sale Conductors are not responsible for any accidents that may occur to consignors, spectators, buyers, horses or equipment for loss from fire, theft, injury or death to any human or animal in any way or manner.
You must obtain a buyers number in order to issue a bid during the sale. Buyer numbers are obtained in the sale office at a cost of $30 per buyer.
The purchase of a buyer's number includes lunch meal, dinner snacks and open bar plus VIP seating in the auction arena. You must sign a buyer's
agreement in order to purchase a pony, either during the sale or prior to the actual auction.
If you are planning to purchase using a debit or credit card, you must present a current drivers license or other photo ID prior to the issuance of the buyer’s number. Current address, phone number is also required. 3% fee added to credit/debit purchases. Cash payments are accepted. **NOTE** tell your bank if you plan to use your debit card. Some banks have set limits on the amount you can debit on one day.
Examine horses prior to bidding. There is no implied warranty made by the Sale Conductors.
All responsibility lies between the consignor and the buyer.
Any horse that receives a bid no higher than $200 will be led out of the sale ring as "unsold".
All additions and corrections announced at the auction will supersede the catalog.
All guarantees of soundness are between buyer and seller.
All sales or transactions made on the sale grounds must be reported to the sale office.
All horses consigned have a current coggins test. (within 12 months of the sale date)
There is no guarantee of disposition or compatibility.
All horses sell "as is"; please examine horses prior to bidding. Buyers have the right to a limited veterinary examination prior to the sale.

All consigned horses must be a minimum of 24 months old.
Ponies consigned to this sale should be suitable for competitive sport ponies, hunter ponies, and competitive driving ponies. This sale is not for "pet" ponies.
Consignors will be paid via check postmarked within two weeks of sale closing.
All horses will be on the sale grounds prior to 10am Saturday, Sept 29, 2012 and available for inspection. Sale office will be open Friday Sept 28th at noon. Many will be available for inspection on Friday, Sept. 28. Gates open at 10am Sept 28, 2012.
Saturday morning, Sept 29, 2012 at 10am: Demonstration of the sale horses will be held in the covered arena. In hand demonstration and under saddle demonstration.
Noon on Saturday: lunch is provided for meal ticket holders and people with buyer’s numbers courtesy of the Sale Conductors.
Saturday, Noon until 5 pm: time to examine individual horses.
3pm until ??: open beer and wine bar with light snacks for individuals with a buyer’s number and open bar arm bands.
5pm: sale begins…..good luck to all.
Stall fees from Friday morning Sept 28th until 10am Sunday Sept. 30, 2012: $60 for weekend per stall. This includes only one bale of shavings. If you strip/sweep your stall before leaving, Sale Conductors will refund $20 of this fee. Extra shavings will be available for $7 per bale.
Grounds fee: for consigned horses being sold without using a stall: $20 per pony. Please clean up around your trailer before you leave.
Consignment fee: per pony: $60
Meal Ticket: $10 includes lunch and beer/wine bar $5 includes only lunch.
All consignors are required to advertise their specific horses on www.dreamhorse.com Instructions for advertising on dreamhorse.com must be followed in order for the auction consignments to be searchable. We also ask that each consignor use their own individual networking skills to get the information to as many people as possible. Email lists, tack shop flyers (see attached flyer), personal website, personal facebook pages etc.
Buyer’s Number: $30 required for all buyers, even consignors that may purchase as well.
There is no "no sale" fee for horses who did not receive an acceptable bid. No buyer’s premium is charged. No hidden fees. No percent of the sale price is charged beyond the 3% for using a credit/debit card. This fee is charged by Paypal, who is handling all credit/debit transactions.
Consignors and buyers are welcome to camp on the grounds for $20 per trailer or camper for the weekend, Friday morning through 10am Sunday morning.
